These Terms of Use govern your access to and use of the Anita Bell Cookware website and online shop (the Website), operated by Castle Trading Corporation Pty Ltd, trading as Anita Bell Cookware (“we”, “us”).

By using the Website or placing an order, you agree to these terms. If you do not agree, please do not use the Website.

About Anita Bell Cookware

Anita Bell Cookware sells ultra-lightweight cast iron cookware and related products. Information on the Website is general in nature and is not medical, nutritional, or other professional advice. Product descriptions, weights, and features are provided in good faith and may be updated from time to time.

Sales to Australia

We currently sell and ship to customers in Australia. We may decline or cancel orders that cannot be fulfilled to an Australian delivery address, or that appear fraudulent or otherwise improper.

Orders and contracts

Placing products in a cart or submitting an order request does not guarantee acceptance. A contract for sale is formed when we accept your order (for example by sending an order confirmation or dispatching goods).

We reserve the right to refuse or cancel orders where products are unavailable, pricing or information errors occur, or we are unable to process payment or deliver safely.

Pricing and payment

Prices are shown in Australian dollars unless otherwise stated, and may change without notice before we accept an order. Applicable shipping charges, taxes, and any stated discounts will be shown at checkout where practicable.

Payment is processed by Stripe through our shop platform (WooCommerce). You must provide accurate payment and billing details. We may use Xero for invoicing and accounting records related to your purchase.

Shipping and delivery

Delivery estimates are indicative only and not guaranteed. Risk in the goods passes in accordance with applicable law and any shipping terms stated at checkout or in order communications. If goods arrive damaged, contact us promptly with photos and your order details so we can help arrange a resolution.

Returns and Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee or other right you may have under law that cannot lawfully be excluded. Change-of-mind returns, if offered, will be described on the Website or in order communications and may be subject to conditions (for example unused goods in original packaging).

Product warranties

Eligible Anita Bell cookware is covered by our 5 Year Limited Warranty. That warranty sits alongside — and does not replace — your rights under the Australian Consumer Law. If there is a conflict between marketing copy and the written warranty terms we publish, the written warranty terms prevail.

Permitted use of the Website

You may use the Website for lawful personal or business purposes related to learning about or purchasing Anita Bell products. You must not:

• use the Website in any way that is unlawful, misleading, harmful, or disruptive;
• attempt to gain unauthorised access to the Website, accounts, or related systems;
• introduce malware, scrape content excessively, or interfere with the Website's operation;
• use forms or messaging features to send spam, abusive content, or false information;
• copy, reproduce, or republish Website content without our prior written permission, except for personal non-commercial use or as allowed by law.

Accounts

If you create an account, you are responsible for keeping your sign-in details confidential and for activity under your account. We may suspend or close accounts where reasonably necessary to protect the Website, other customers, or to enforce these terms.

Intellectual property

Unless otherwise stated, content on the Website — including text, images, logos, product names, and design — is owned by or licensed to Castle Trading Corporation Pty Ltd and protected by copyright and other intellectual property laws. The Anita Bell name and branding must not be used without permission.

Third-party links and marketplaces

The Website may link to third-party websites or services (for example social media or Amazon). We do not control and are not responsible for their content, availability, or practices. Purchases made on third-party marketplaces may be subject to that marketplace's terms as well as ours.

Privacy

Disclaimer of warranties

To the maximum extent permitted by law, and subject to the Australian Consumer Law section above, the Website is provided on an “as is” and “as available” basis. We do not warrant that the Website will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, Castle Trading Corporation Pty Ltd is not liable for any loss or damage arising from your use of (or inability to use) the Website, including indirect, incidental, or consequential loss — except where liability cannot be excluded under the Australian Consumer Law or other applicable legislation.

Indemnity

You agree to indemnify Castle Trading Corporation Pty Ltd against claims, losses, or expenses arising from your breach of these terms or misuse of the Website, except to the extent caused by our negligence or misconduct.

Governing law

These terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of Australian courts.

Changes

We may update these Terms of Use from time to time. Continued use of the Website after changes are posted constitutes acceptance of the updated terms. For orders already accepted, the terms in force at acceptance continue to apply to that order unless required otherwise by law.
